1. The Service

Samon is a speed-to-lead, lead organization, and alert platform that helps businesses capture inbound leads, respond to them automatically, and notify business staff so that leads are followed up with promptly. The Service includes capturing calls and form submissions, sending automated text responses and follow-ups, and sending internal alerts to business staff.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service as a Business User. By using the Service, you represent and warrant that you meet these requirements.

3. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date. Notify us immediately of any unauthorized use of your account.

4. SMS / Text Messaging Terms

By opting in to receive text messages — whether by contacting a business that uses Samon, scanning a QR code, submitting a web form with consent, or texting a keyword such as START — you agree to the following:

  • You consent to receive text messages related to your inquiry, including automated responses, follow-ups, scheduling, and updates, from the business you contacted via the Samon platform.
  • Message frequency varies depending on your interaction with the business.
  • Message and data rates may apply, according to your mobile carrier plan.
  • You may opt out at any time by replying STOP. After opting out, you will receive one confirmation message and no further messages.
  • For assistance, reply HELP or contact {support email / phone}.
  • Carriers are not liable for delayed or undelivered messages.
  • Consent to receive messages is not a condition of purchasing any goods or services.

Your mobile opt-in information and phone number will not be sold or shared with third parties for marketing purposes, as described in our Privacy Policy.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any law, regulation, or third-party right;
  • Send unlawful, harassing, deceptive, or unsolicited messages, or otherwise violate telemarketing, anti-spam, or messaging laws (including the TCPA, CAN-SPAM, and applicable carrier and A2P 10DLC rules);
  • Contact individuals who have not provided lawful consent;
  • Transmit malware, attempt to gain unauthorized access, or interfere with the Service;
  • Misrepresent your identity or your affiliation with any person or business.

Business Users are solely responsible for ensuring they have a lawful basis and any required consent to contact their own leads and customers through the Service.

6. Business User Responsibilities

If you use Samon to communicate with your own leads and customers, you are responsible for:

  • Obtaining and maintaining all legally required consents from the individuals you contact;
  • Complying with all applicable laws and carrier requirements;
  • The content of messages you send or configure to be sent;
  • Honoring opt-out requests.

You agree to indemnify and hold Samon harmless from any claims arising out of your messaging practices or your violation of these Terms.

7. Fees and Payment

Certain features of the Service require payment. Fees, billing cycles, and applicable terms will be presented at the time of purchase. Unless otherwise stated, fees are non-refundable. We may change pricing with reasonable notice.

8. Third-Party Services

The Service relies on third-party providers, including telecommunications and messaging carriers and hosting providers. We are not responsible for the acts, omissions, or failures of these third parties, and message delivery is subject to their networks and policies.

9. Intellectual Property

The Service, including all software, design, text, and branding, is owned by {Legal Company Name} and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT MESSAGES WILL BE DELIVERED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, {LEGAL COMPANY NAME} WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification
